Layer Terms of Service
Interim Terms. This version is public while legal review continues. Layer will ask you to accept it only where an acceptance control is available. We will post material changes here before they take effect.
These Terms govern your use of the Layer iOS and Apple Watch apps, the web app, layertoday.com, Layer Feedback, the Help Center, and related services. Apple's standard end-user license agreement also applies to the iOS and Apple Watch apps unless the App Store listing provides a custom agreement.
The agreement is between you and Aaron Wang d/b/a Layer, referred to as “Layer,” “we,” or “us.”
1. Accepting these Terms
When Layer shows an acceptance control, selecting it means you agree to the version of these Terms shown with that control. Creating an account, browsing, or using a feature without that control does not create an acceptance record. If you do not agree, do not select the control or use the feature that requires it.
If you use Layer for an organization, you represent that you are authorized to bind that organization. “You” then includes the organization.
2. Eligibility
You must be at least 13 and legally able to enter this agreement. If the law where you live requires parental or guardian consent, you may use an account or post content only after that consent has been provided through a method Layer supports.
Layer is not directed to children under 13. Do not create an account or submit personal information for a child under 13.
3. What Layer provides
Layer interprets weather and the run details you choose to provide to recommend clothing and explain how conditions may feel. The iOS app can also store run and gear information, sync supported records through a private iCloud database, connect to optional services, and provide reminders or Live Activities. The web app provides a shorter, account-free recommendation experience. Layer Feedback and the Help Center provide public ideas and support material.
Features can differ by device, location, account state, permission, provider availability, and app version. Layer may add, change, suspend, or discontinue a feature. When practical, Layer will give notice before a change that materially affects an ongoing service.
Layer is free as of September 1, 2026. These Terms do not authorize a subscription or other payment. If Layer later offers a paid service, it will provide additional terms and required purchase information before charging you.
4. Weather, health, and safety limits
Layer is a clothing and weather-guidance product. It is not a medical device, health-care provider, emergency service, severe-weather warning system, or substitute for professional judgment.
- Forecasts and provider data can be delayed, incomplete, or wrong.
- A clothing recommendation does not say that conditions, a route, or a planned run are safe.
- Heat, hydration, sun, cold, and effort notes are general information, not diagnosis, treatment, or a personal medical plan.
- Layer does not monitor you during a run or contact emergency services.
Check current conditions and official local alerts, including lightning, air quality, wildfire, flood, road, trail, and severe-weather information. Use what you can observe. Change or stop your plans if conditions differ from the forecast. If you feel unwell or face an emergency, stop and seek appropriate professional or emergency help. Consult a qualified health professional before making medical decisions or if you have questions about exercise in your circumstances.
You remain responsible for your clothing, route, effort, timing, permissions, and decision to run. Nothing in this section limits rights or remedies that cannot legally be limited.
5. Accounts and security
Some iOS features use Sign in with Apple. Some portal features use magic-link email authentication. You agree to provide accurate information, protect access to your email and devices, and notify help@layertoday.com if you believe an account has been compromised.
You are responsible for activity under your account unless applicable law provides otherwise. Do not share authentication links, tokens, or credentials. Layer may require reauthentication before a sensitive action such as account deletion.
Deleting the iOS account and deleting the separate Layer Feedback account are different actions. See the Privacy Policy and in-product controls for available deletion and export methods.
6. Permissions and third-party services
You choose whether to grant location, HealthKit, notification, camera, photo-library, Strava, and other optional access. You can change most permissions in device or service settings, although a feature may stop working without the permission it needs.
Apple, Strava, weather providers, and other third-party services have their own terms. You must follow applicable third-party terms, including your wireless-data and Apple Media Services terms. Layer is not responsible for a third party's service, data, availability, or independent conduct, except to the extent applicable law says otherwise.
7. Privacy
The Layer Privacy Policy explains how Layer handles personal information. Privacy or health-data consent remains separate from accepting these Terms when the law requires separate consent.
8. Your content
“Your Content” means text, images, ideas, comments, votes, display names, bug reports, and other material you submit to Layer. You keep ownership of Your Content.
You give Layer a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, transmit, moderate, and otherwise use Your Content only as needed to operate, secure, improve, and promote the service in which you submitted it. For public Layer Feedback content, this license includes displaying the content publicly and using a post title or excerpt to describe the portal. The license ends when the content is deleted, except for reasonable technical backups, content others have separately shared, and records Layer may lawfully retain.
Do not submit content unless you have the rights and permissions needed to do so. Public posts may be copied or discussed by other people. Do not post private run, health, exact-location, account, or authentication information.
9. Feedback about Layer
If you voluntarily send an idea, suggestion, or product feedback, you allow Layer to use it without restriction or payment. This does not transfer ownership of personal information included in the feedback, which remains subject to the Privacy Policy.
10. Acceptable use
You may not:
- break the law or another person's rights;
- threaten, harass, impersonate, defame, exploit, or deceive another person;
- post illegal, hateful, sexually exploitative, privacy-invasive, or infringing material;
- expose another person's personal, location, health, account, or confidential information without authority;
- spam, manipulate votes, create deceptive accounts, or evade a moderation action;
- introduce malware, probe for vulnerabilities without written authorization, disrupt the service, or bypass access, rate-limit, security, or territorial controls;
- scrape, crawl, copy, reverse engineer, or use automated means against the service except as the law expressly permits or Layer authorizes in writing;
- use Layer data or content to train a model or build a competing dataset without written permission; or
- use a weather or clothing recommendation as an official safety warning, medical instruction, or representation that Layer made a safety determination.
Layer may investigate and remove content, restrict an account, preserve evidence, or report conduct when reasonably necessary to enforce these Terms, protect people or the service, or comply with law.
11. Moderation and reports
Layer may remove or reduce visibility of content that violates these Terms, is misplaced, exposes personal information, or creates legal or security risk. Layer may close inactive, duplicate, or abusive accounts. Moderation decisions may involve judgment and may not be immediate.
Report objectionable or infringing content to help@layertoday.com with the URL and a clear description. Do not send sensitive identity documents unless Layer asks through a secure method.
12. Copyright complaints
If you believe content on Layer infringes copyright, send a notice to help@layertoday.com that identifies the protected work, the material and its location, your contact information, a good-faith statement, an accuracy-and-authority statement made under penalty of perjury, and your physical or electronic signature.
Layer may remove material and notify the person who posted it. That person may provide a valid counter-notice. Layer may terminate repeat infringers when appropriate.
Send copyright notices to Aaron Wang d/b/a Layer at help@layertoday.com. Layer does not represent this contact as a Copyright Office-registered DMCA agent.
13. Layer's rights
Layer and its licensors own the service, software, design, documentation, branding, and other materials Layer provides, excluding Your Content and third-party material. Subject to these Terms, Layer gives you a personal, limited, revocable, non-exclusive, non-transferable license to use the service for its intended purpose. Apple's standard end-user license agreement also applies to the iOS and Apple Watch apps unless the App Store listing provides a custom agreement.
No right is granted to use Layer's name, logo, or other marks without written permission.
14. Suspension and termination
You may stop using Layer at any time. You can use the available account controls or contact support for deletion.
Layer may suspend or terminate access if you materially or repeatedly violate these Terms, create a security or legal risk, or if Layer must do so by law. When appropriate, Layer will provide notice and a reasonable opportunity to appeal or cure. Immediate action may be necessary for serious harm, security threats, illegal content, or repeated abuse.
Sections that by their nature should continue, including ownership, permitted retention, disclaimers, liability, dispute terms, and third-party-beneficiary terms, survive termination.
15. Disclaimers
To the maximum extent permitted by law, Layer is provided “as is” and “as available.” Layer does not promise uninterrupted or error-free service, accurate forecasts, safe conditions, a particular result, or that every feature will remain available. Layer disclaims warranties that may legally be disclaimed, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
These disclaimers do not exclude a warranty or consumer right that cannot be excluded where you live.
16. Limitation of liability
To the maximum extent permitted by law, Layer and its service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, revenue, data, goodwill, or opportunity, arising from or related to Layer.
To the maximum extent permitted by law, Layer's total liability for all claims arising from or related to the service will not exceed the greater of:
- US$100; or
- the amount you paid Layer for the service during the 12 months before the event giving rise to the claim.
These limits do not apply to liability that cannot legally be limited, including where applicable for fraud, willful misconduct, gross negligence, death or personal injury caused by negligence, or mandatory consumer-protection rights.
17. Indemnity
To the extent permitted by law, if you use Layer on behalf of a business or organization, that organization will defend and indemnify Layer against third-party claims caused by its unlawful use, Your Content, or material breach of these Terms. This section does not apply to individual consumers where prohibited by law.
18. Governing law and disputes
These interim Terms do not select a governing law or court. A dispute may be brought in a court that has jurisdiction under applicable law. These Terms do not require arbitration. They do not remove consumer rights or remedies that apply where you live, and they do not prevent either party from using a small-claims court that has jurisdiction or seeking emergency relief where the law allows.
19. Changes to these Terms
Layer may update these Terms to reflect product, legal, or security changes. The new version will show its effective date. Layer will provide legally required advance or in-product notice and ask for renewed acceptance when a material change requires it. Earlier versions will remain available by emailing help@layertoday.com until Layer adds a public archive.
20. General terms
If a provision is unenforceable, it will be limited or removed only to the extent necessary, and the rest remains effective. A delay in enforcement is not a waiver. You may not transfer this agreement without Layer's consent; Layer may transfer it as part of a legitimate reorganization or sale, subject to applicable notice and privacy requirements. These Terms are the entire agreement between you and Layer about the covered services. Apple's standard end-user license agreement also applies to Apple-platform software. The Privacy Policy describes Layer's data practices and legal obligations. Accepting these Terms does not provide a separate privacy or health-data consent.
Headings are for convenience. “Including” means “including without limitation.” Nothing in these Terms creates an employment, agency, partnership, fiduciary, or joint-venture relationship.
